Thank you for using FastImage. These Terms of Service ("Terms") govern your access to fastimage.art and our AI image editing and generation services (collectively, the "Services"). By creating an account or using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
- You must be at least 13 years old to use FastImage.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Provide accurate information when registering and keep it up to date.
2. Credits, subscriptions, and payments
- Some features require purchasing credits or a subscription. Prices are listed in the app and may change with advance notice.
- Payments are processed securely by our payment provider. You authorize us to charge your selected payment method for recurring subscriptions.
- Credits are non-transferable. Please review our refund policy on the pricing page. Promotional credits may expire.
3. Acceptable use
When using FastImage you agree not to:
- Upload content that violates the law, infringes intellectual property rights, or depicts harmful, abusive, or hateful material
- Attempt to reverse engineer, interfere with, or misuse the Services
- Use the Services to create misleading, deceptive, or harmful content
- Circumvent security controls or use automated tools to abuse our infrastructure
We may suspend or terminate accounts that violate these rules.
4. Your content
- You own the rights to images, prompts, and other content you upload to the Services.
- You grant FastImage a limited, non-exclusive, worldwide license to host, process, and display your content solely to provide and improve the Services.
- You are responsible for ensuring you have the rights to any third-party content you upload.
5. Generated output
- Subject to these Terms and applicable law, you may use images generated by FastImage for personal or commercial purposes.
- FastImage does not guarantee that generated content will be unique or free from intellectual property restrictions. You are responsible for reviewing and ensuring appropriate use of outputs.
6. Privacy and data
Our Privacy Policy explains how we collect and use personal information. By using the Services you consent to those practices.
7. Service changes and availability
- We may modify, discontinue, or suspend features at any time. We will provide notice of material changes when feasible.
- FastImage may experience downtime as we perform maintenance or respond to incidents. We are not liable for unavailability or data loss.
8. Disclaimer of warranties
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent allowed by law:
- FastImage will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data.
- Our aggregate liability for any claim relating to the Services will not exceed the amount you paid to FastImage in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless FastImage and its team from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.
11. Governing law
These Terms are governed by applicable local laws. Any disputes should first be resolved through good faith negotiation. If formal resolution is required, it will be handled according to the jurisdiction where the service is provided.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services before the new Terms take effect. Continuing to use the Services after the changes become effective constitutes acceptance of the revised Terms.
